What assets are safe in a divorce?
If you own your house in joint tenancy, your spouse cannot transfer that house without your signing the documents. If a deed is signed by forging your name, it’s a fraudulent conveyance and it’s very unlikely to happen. Retirement assets that are held only in your spouse’s name or your name, and they’re not held in joint names, are very difficult and very expensive to liquidate. They can’t be transferred without tax consequences outside of a divorce, frankly, unless there is a tax-free rollover.
